The West Bengal Municipal (Duties and Responsibilities of the Executive Officer) Rules, 2003

 

In exercise of the power conferred by sub-section (1) of section 417, read with sub-section (2) of section 60A of the West Bengal Municipal Act, 1993(West Bengal Act XXII of 1993) (hereinafter referred to as the said Act), the Governor is pleased hereby to make, after previous publication as required by sub-section (1) of section 417 of the said Act, the following rules :

 

 

CHAPTER I

 

A. Preliminary 
 
1. Short title, commencement and application.

 

(1). These rules may be called the West Bengal Municipal (Duties and Responsibilities of the Executive Officer) Rules, 2003.

(2).They shall come into force on the date of their publication in the Official Gazette.

(3).These rules shall apply to all the Municipalities and Notified Area Authorities guided by the West Bengal Municipal Act, 1993 (West Ben. Act XXII of 1993).

2. Definition n these rules

(a) “Act” means the West Bengal Municipal Act,1993 (West Ben. Act, XXII of 1993);
(b) “Executive Officer” means the Executive Officer of the Municipality or Notified Area Authority appointed under section 60 of the Act;
(c) “Rule” means a rule of these Rules.

 

B. The words and expressions used in these rules, but not defined, shall have the same meaning as in the Act

 

CHAPTER II

 

Duties and Responsibilities of the Executive Officer

3 Duties and Responsibilities of the Executive Officer. Duties and responsibilities of the Executive Officer shall be as under :

 

(1) To act as the principal officer of the Municipality subject to the supervision and control of the Chairman;
(2) To assign the duties among officers and employees of the Municipality with the approval of the Chairman, and exercise supervision and control over the functions of all officers and employees of the Municipality.
3) To act as principal coordinating officer for Implementation of various plan/non-plan schemes of the Municipality;
(4) To prepare the budget estimate of the municipality with the help of the Finance Officer, If any;
(5) To submit all report returns to Director Local Bodies, West Bengal, the District Magistrate concerned, Municipal Engineering Directorate, West Bengal, State Urban Development-Agency, West Bengal Valuation Board and other agencies as well as to the State Government, which may be required from time to time.
(6) To attend to the daily DAKs and to make necessary arrangement for proper distribution of the same after placing them before the Chairman;
(7) To act as the Secretary to the Chairman-in-Council, to compile agenda for approval of the Chairman, to prepare and maintain proceedings of the meetings & to initiate follow-up action on the decision, of the meetings;
8) To attend meetings of the Board of Councillors’, If required, to render secretarial assistance to the Board of Councillors, to furnish the Chairman with the agenda to be proposed by different authorities, and to prepare and maintain the minutes of the meetings of the Board of Councillors with the assistance of the Municipal Secretary or, in his absence, of any other officer. He shall ensure submission of these proceedings to the concerned authorities as per the said Act and the Rules made thereunder and initiate follow-up action in terms of the decisions of the meeting of the Board of Councillors;
(9) To countersign the travelling allowance bills of the employees as required in the West Bengal Municipal (Finance & Accounting) Rules,
(10) To sanction temporary advance from General Provident Fund to all employees subject to the terms and conditions as laid down in the General Provident Fund Rules meant for Municipal Employees;
(11) To authenticate the entries in the Service Books of all employees of the Municipality;
(12) To grant periodical increment of pay to all the employees of the Municipality;
(13) To act as the competent authority for accepting options exercised by the employees and to sign the initial pay-fixation statement as head of the establishment;
(14) To examine proposals for all kinds of purchase and to make a recommendation to the appropriate authority in prior consultation with the Finance Officer in regard to the availability of fund;
(15) To invite tenders for various purchase duly approved, to examine such tenders and to prepare a comparative statement for furnishing the same with his views to the appropriate authority, for the final decision, after observing all the formalities as laid down in rules 160 of the West Bengal Municipal (Finance & Accounting) Rules, 1999;
(16) To make or cause to be made physical verification of stock and stores and to certify the balances thereof half-yearly as per provisions of the West Bengal Municipal (Finance & Accounting) Rules, 1999;
(17) To draw the attention of the Chairman to any Irregularities if any, In the decisions taken by the Chairman-in-Council;
(18) To act as the convener of the Tax Monitoring Cell of the Municipality and to take necessary measures for augmentation of municipal tax and non-tax revenue;
(19) To ensure support for the proper functioning of Municipal Accounts Committee;
(20) To extend the necessary support for the proper functioning of the ward committees, to maintain quarterly report regarding the functioning of the ward
committees and submit the same to Directors of Local Bodies, West Bengal through the Chairman of the Municipality;
(21) To sign cheques in absence of Finance Officer as per provision of the West Bengal Municipal (Finance & Accounting) Rules, 1999;
(22) To ensure regular submission of the annual administration report as required under the Act and rules made thereunder.
(23) To issue a certificate of enlistment as required under Section 118 of the Act;
(24) To act as Inquiring Officer in respect of municipal employees in case of disciplinary action;
(25) To ensure timely preparation of the broad-sheet replies to the audit notes with the necessary assistance of the Finance Officer
(26) To oversee the proper maintenance of, and to authenticate the records entered into the Establishment Cheque Register;
(27) To keep informed the Chairman/Chairman-in-Council on any policy guideline of the State Government
(28) To place before the Chairman any matter involving violation of any statutory provision;
(29) To perform such other functions as laid down in the Act and rules made thereunder;
(30) To prepare or cause to be prepared draft regulations as may be required under different sections of the Act
(31) To perform such other duties as may be delegated to him by the Chairman or assigned by the State Government from time to time.
